Terms of Service
Article 1 Purpose
These Terms of Service set forth the conditions of use and other matters concerning the operation of the services provided by “Deepmedi” (hereinafter “Deepmedi”).
Article 2 Definitions
① Member: A user who has agreed to these Terms, provided personal information, and registered as a member in order to receive the services.
② Service Agreement: The agreement entered into between the App and a Member in connection with use of the App.
③ User ID (E-mail): An e-mail format selected by the user and approved by the Company for member identification and use of the services.
④ Password: A combination of letters and numbers selected by the Member to verify that the Member matches the issued e-mail address and to protect the Member's rights and interests.
⑤ Withdrawal: Termination of the Service Agreement by the Member.
Article 3 Posting and Amendment of Terms
① “Deepmedi” posts these Terms on the initial service screen of the App so that users can review them.
② “Deepmedi” may amend these Terms for the purpose of improving the services. Amendments will be announced to Members and will take effect from the date of notice.
③ Members have the right to reject amended Terms. A Member who objects to an amendment may stop using the services and withdraw from membership. If a Member continues to use the services after the effective date of the amended Terms, the Member is deemed to have agreed to the amended Terms.
④ Matters not specified in these Terms shall be governed by applicable laws and regulations.
Article 4 Account
① “Deepmedi” may delete an account without prior notice to the customer if more than one year has elapsed since the last access.
② Please note that an account cannot be restored even if it is deleted by the customer's mistake.
③ Accounts for this service are personal and exclusive to the customer. All rights to use this service held by the customer may not be transferred, lent, or inherited by any third party.
Article 5 Service Application and Formation of Agreement
① A Service Agreement between the Company and a user is formed when a person who wishes to use the services provided by “Deepmedi” agrees to these Terms, applies for use according to the forms and procedures presented by the Company, and the Company accepts the application. However, applicants under the age of 14 may not use this service.
② Once the Service Agreement is formed, the Company performs member management through e-mail, and the Member may use the services in accordance with these Terms, service-specific operating policies, and rules established by the Company.
③ Members must prepare mobile phone devices, communication means, electricity, and other items necessary to use this service at their own cost and responsibility.
Article 6 Privacy
① “Deepmedi” respects customers' privacy.
② “Deepmedi” uses utmost care in security to safely manage information collected from customers.
Article 7 Obligations of the Contracting Parties (Obligations of “Deepmedi”)
① “Deepmedi” will not disclose or distribute a Member's personal information learned in connection with providing the services to any third party without the Member's consent.
② “Deepmedi” may prepare and use statistical data concerning the personal information of all or some Members in connection with its business.
Article 8 Obligations of the Contracting Parties (Obligations of “Members”)
① When registering information related to themselves for use of this service, Members must provide true, accurate, and complete information and must update it so that the latest information is always reflected.
② Members must not engage in any act that violates applicable laws or the conditions of use set by “Deepmedi”.
Article 9 Service Hours
① In principle, the services are available 24 hours a day, year-round, unless there is a special operational or technical obstacle for “Deepmedi”. This does not apply to days or times designated by “Deepmedi” as necessary, such as for regular inspections.
Article 10 Content (Services)
① When using content for which conditions of use such as fees or usage periods are separately specified, Members must comply with those conditions. Even if terms such as “purchase” or “sale” are displayed on the service screen, intellectual property rights and other rights concerning the content provided by the Company to customers are not transferred to customers, and customers are granted only the usage rights described above.
② Members must not use the content beyond the forms of use predetermined by this service, including copying, transmitting, reproducing, or modifying it.
Article 11 Withdrawal and Termination
① When withdrawing, the Member must apply for withdrawal through the App.
② “Deepmedi” may withdraw or terminate a Member's agreement without prior notice, or suspend service use for a specified period, if the Member engages in any of the following acts.
- a)Intentionally interfering with service operation
- b)Infringing copyrights, trademarks, patents, other intellectual property rights, reputation rights, privacy rights, or other statutory or contractual rights of “Deepmedi” or a third party
- c)Intentionally distributing content that undermines public order or good morals
- d)Using another person's ID or password without authorization
- e)Planning or carrying out service use for the purpose of harming national interests or social public interests
- f)Exchanging content usage rights for cash, property, or other economic benefits by a method other than those designated by “Deepmedi”
- g)Distributing computer virus programs or similar items that cause malfunction of information and communication facilities or destruction of information
- h)Posting, promoting, or distributing obscene writings or materials
- i)Suspending the system or causing operational problems through gross negligence or hacking
- j)Engaging in an act that violates the law
- k)Otherwise interfering with sound App operation
Article 12 Disclaimer
① “Deepmedi” is exempt from liability for providing the services if it is unable to provide the services due to natural disasters or other force majeure events equivalent thereto.
② “Deepmedi” is not liable for service disruptions caused by reasons attributable to Members.
③ “Deepmedi” is not liable for damages arising from profits expected by Members through use of the services or from materials obtained through the services.
④ The user bears legal responsibility for the contents of e-mails sent by the user.
Article 13 Intellectual Property Rights
① Content, services, software, trademarks, and other items for which “Deepmedi” holds intellectual property rights may not be modified in whole or in part, rented, lent, distributed, produced, transferred, sublicensed, pledged, or commercially used without the written consent of “Deepmedi”, and no third party may be permitted to engage in such acts.
Article 14 Jurisdiction
If a lawsuit is filed over a dispute arising from use of the services, the court having jurisdiction over the Company's location shall be the exclusive court of jurisdiction.
Addendum
(Effective Date) These Terms take effect on April 1, 2019.
